EAGLE SITE SERVICES – CUSTOMER RENTAL AGREEMENT

GENERAL TERMS (Applicable to All Rentals)

Delivery & Pickup
Deliveries and pickups will be scheduled at a mutually agreeable time. If there are delays not caused by Eagle Site Services (ESS), a $75 fee will be charged for each 30-minute increment per delivery or pickup truck. Units must be accessible within 20 feet of a paved or gravel road.

Refunds & Rental Periods
ESS charges a flat rate per rental period, which will not be prorated. No refunds will be issued for early pickup requests made after an invoice is created. You must call to request pickup—estimated end dates do not schedule removal.

Access & Service
Locked gates or blocked access may prevent service and are not eligible for refunds. Only combination locks are acceptable for locked areas. If a unit is inaccessible due to obstructions or relocation without notice, a $100 relocation fee may apply.

Late Payments & Fees
Payment is due per the due date listed on your invoice. Late payments are subject to a 10% fee every 28 days overdue. If service is halted due to nonpayment more than twice, a credit card must remain on file for future invoices. ESS does not accept checks. All payments must be made by credit/debit card.

Graffiti Policy
Customers are responsible for graffiti removal charges based on size:

  • $50 for graffiti that fits under one hand

  • $75 for graffiti that fits under two hands

  • $100 for larger graffiti

Promotions
Any promotions offered by ESS are subject to change or cancellation at any time without notice. ESS reserves the right to modify, suspend, or discontinue promotional discounts in the event of excessive usage, unforeseen cost increases, or abuse of the offer.

Other Terms

  • ESS does not offer damage waivers or unit anchoring.

  • Units must not be used for trash, hazardous waste, or non-human waste. Additional fees will apply if violated.

  • If a unit is tipped over, an additional fee will apply for cleaning.

  • Toilet paper and hand sanitizer dispensers are provided in every unit.

  • ESS is not liable for any damages caused to driveways, lawns, or surfaces during delivery or pickup.

  • Units must not be moved from one location to another without written approval.

  • A fuel surcharge may apply based on current diesel prices.

Weather & Unforeseen Events
ESS is not responsible for delays or service disruptions due to severe weather, natural disasters, road closures, or other events beyond our control. No refunds will be issued under these circumstances.

Digital Agreement
Submission of an order and/or payment constitutes acceptance of these terms. Digital signatures and email confirmations are valid and binding.

CONSTRUCTION RENTALS

Unit Guidelines
One unit is designed for up to 10 workers during a 40-hour work week. Additional units or 2x/week servicing may be required during high heat or longer shifts.

Relocation & Maintenance
Do not move units between job sites without prior approval. If units are moved without authorization, a $100 fee will be assessed. Notify ESS immediately if any damage occurs.

Service Terms
Standard rental includes once-weekly servicing. If additional servicing is required, it will be billed separately. Units must be accessible on scheduled service days.

EVENT RENTALS

Payment Terms

  • 50% of the rental invoice is due to reserve units.

  • Final payment is due the day prior to delivery.

  • All payments are non-refundable unless canceled in writing per the terms below.

Cancellation Policy

  • Cancelation more than 15 days prior to delivery: Full refund minus $25 processing fee

  • Cancellation 8–14 days: 50% refund

  • Cancellation 3–7 days: 25% refund

  • Cancellation 2 days or less: No refund

Customer Responsibilities

  • Units must be placed in a safe, accessible location.

  • Customer is liable for any damage due to vandalism or misuse.

  • No refunds or credits will be issued for units that cannot be serviced due to blocked access.

  • For events requiring 3 or more units, a site map or on-site contact must be provided at least 24 hours before delivery.

  • Additional fees may apply for after-hours or holiday service.

LIABILITY & INDEMNIFICATION

Customer agrees to defend, indemnify, and hold harmless Eagle Site Services and its employees from any and all third-party claims related to the use or misuse of equipment, excluding claims resulting from ESS’s own negligence.

Customer accepts full responsibility for ESS equipment from time of delivery to time of pickup.

EQUIPMENT REPLACEMENT COSTS

If a unit or accessory is stolen, vandalized beyond repair, or otherwise destroyed, customer agrees to pay the replacement cost:

  • Standard Portable Toilet: $1,200

  • ADA/Wheelchair Accessible Unit: $2,300

  • Hand Wash Station: $800

  • Holding Tank: $1,500

  • Toilet Paper Holder: $65

  • Hand Sanitizer Dispenser: $65
